VOCATIONAL ASSESSMENTS


Vocational assessments (which can also be known as vocational evaluations) take a comprehensive look at an individual’s education, training, work history, and residual functional capacity (if applicable) to determine transferable skills, current and future earning capacity, and availability of reasonable jobs in their local labor market. Vocational assessments are used in a wide variety of practice areas:

 

Personal Injury/ Motor Vehicle Accident Cases


In personal injury cases, which may include slips-and-falls, motor vehicle accidents, objects falling, and other causes of injury, our job as Vocational Experts is to determine any potential lost wages and/or the earnings capacity of the injured party. We can also determine what jobs, if any, the individual may be able to perform given their residual physical and/or psychological functional capacity.


This assessment is based on the education and employment history of the injured party, the expected length and severity of the injury, current labor market conditions, and a variety of other factors. Despite the complicated and varied nature of these vocational assessments, we provide accurate, unbiased opinion that is backed up with facts, research, and years of experience.

 

Medical Malpractice Cases


Similar to personal injury cases, a Vocational Expert working on a medical malpractice case is tasked with determining the employability, placeability, and earning capacity of the individual in the case.


Based on the nature of the injury, the individual’s occupation and qualifications, and other factors, we offer testimony on the value of potential lost wages or residual earnings capacity.

 

Employment and Bankruptcy Law


In employment cases, we take a comprehensive look at an individual’s qualifications, training, and work history, to determine current and/or future earnings capacity or lost wages. When significant debt is accumulated and/or bankruptcy is filed, a Vocational

Expert may be beneficial to determine an individual’s ability or inability to generate income. Family Law


The purpose of a Vocational Expert in a divorce case is to determine the employability, placeability, and expected earnings of a spouse. This assists the court with determining an appropriate level of alimony (spousal) and child support.

When filing for LTD or TDIU disability, sometimes an opinion from a Vocational Expert is needed. We review medical records, ratings, and other documentation pertinent to a case.
